Distance Sales Agreement<\/strong><\/p>\n

This agreement sets out the general terms of distance sales between the seller and the consumer for orders placed through the Hrant Dink Foundation D\u00fckkan store. The product’s essential characteristics, quantity, tax-inclusive price, any discounts and delivery charges, payment method, buyer and delivery details are determined by the checkout summary shown before confirmation and the order records sent afterwards. The pre-contract information forms an integral part of this agreement.<\/p>\n

1. Parties and contact details<\/h2>\n

Buyer:<\/strong> The consumer whose name, contact and address details are given with the order. Written withdrawal and return notices may be sent to the email address above.<\/p>\n

2. Subject and conclusion of the contract<\/h2>\n

The product or service name, essential characteristics, quantity, options and order-specific details appear on the product page and at checkout. Confirming an order creates an obligation to pay. The contract is concluded when the consumer has been shown the pre-contract information and these terms and confirms the order. A product being out of stock does not, by itself, constitute impossibility of performance. If delivery or performance genuinely becomes impossible, the consumer will be informed and all payments refunded within the periods required by law.<\/p>\n

3. Price and payment<\/h2>\n

The total price, including applicable taxes, shipping\/delivery and any other mandatory charges, is shown before payment. No additional charge is imposed without the consumer’s express consent. Only payment methods presented at checkout may be used; the payment provider’s own security and transaction terms may also apply. Discounts and coupons applied to the order are reflected in the checkout total.<\/p>\n

4. Delivery and performance<\/h2>\n

Physical products are dispatched to the delivery address and by the delivery option stated at checkout. If no specific dispatch period has been promised, the product will be dispatched within 30 days at the latest. Statutory termination and refund rights remain available if delivery is delayed or performance becomes impossible. Except where the consumer chooses a carrier other than that offered by the seller, the seller bears the risk of loss or damage until the goods are delivered to the consumer or a third party designated by the consumer. The timing and method of performance for dated events or digital services are stated on the relevant product page and in the order summary.<\/p>\n

5. Right of withdrawal<\/h2>\n

Unless a statutory exception applies, the consumer may withdraw from a purchase of physical goods within 14 days of delivery, without giving a reason or paying a penalty. For services, the period generally begins when the contract is concluded. The consumer may also notify withdrawal before physical goods are delivered. An unequivocal written statement may be emailed to dukkan@hrantdink.org<\/a>; a telephone call alone is not sufficient. Including the order number, name and affected product helps process the request.<\/p>\n

After notifying withdrawal, the consumer must send the goods back within 14 days. The return address is the seller’s address above; the consumer may email first for instructions on the return procedure and carrier. Where a return carrier was specified in the pre-contract information, use of that carrier does not create a return-shipping charge for the consumer. Where none was specified, the consumer may use any carrier without being charged for return shipping. Subject to the applicable legal conditions, the seller refunds payments, including initial delivery costs, within 14 days, without imposing a fee and by a means compatible with the original payment method. The starting point of the refund period for returned goods may depend on the carrier used and when the goods are handed over or received.<\/p>\n

6. Exceptions to withdrawal<\/h2>\n

Exceptions listed in Turkish consumer law and the Distance Contracts Regulation apply only where their specific conditions are met. Examples may include goods made to the consumer’s specifications; goods whose protective packaging has been opened after delivery and which are unsuitable for return for health or hygiene reasons; books whose protective packaging has been opened after delivery; and certain leisure services to be performed on a specified date. Merely examining a book does not automatically extinguish the right of withdrawal in every case. Any applicable exception and cancellation terms for an event reservation must also be disclosed on its product page before purchase. Statutory rights relating to defective goods or services are unaffected.<\/p>\n

7. Defective goods, complaints and disputes<\/h2>\n

If a product is defective, the wrong product is delivered or a delivery issue arises, the consumer may contact the seller at dukkan@hrantdink.org<\/a>. Rights under Turkish Consumer Protection Law No. 6502 remain available independently of the withdrawal right. Disputes may be brought before the competent consumer arbitration committee or consumer court in accordance with the monetary thresholds and jurisdiction rules in force; other statutory remedies remain available.<\/p>\n

8. KarDes Club membership<\/h2>\n

An automatically renewing KarDes Club membership has payment, renewal and cancellation terms different from a one-off product sale. This agreement alone does not replace the specific membership terms or pre-contract information needed for recurring payments. Before such a membership is offered for sale, the plan price, billing period, renewal, cancellation and relevant consumer rights must be presented separately and clearly.<\/p>\n
